SMS Opt-In Terms and Conditions

Thank you for opting into SMS communications from HITMKR ("we," "us," or "our"). By providing your phone number and opting into our SMS service, you agree to the following terms and conditions.


1. Program Description

By opting in, you agree to receive SMS messages, including transactional, promotional, and marketing communications, from HITMKR. These messages may include updates, offers, reminders, and other relevant information.


2. Opting In

Step 1: Gaining consent
Our campign opt-in flow starts with a web form where we collect information for consent to send text messages. The form collects first name, last name, email, and phone number with country code. There is a checkbox that users have to select in order to give us consent. The checkbox is paired with the following message:

- "By submitting this form and entering your phone number above, you agree to receive automated text messages from HITMKR and agree to our Terms and Privacy . Consent is not a condition of any purchase. Msg frequency varies. Msg and data rates may apply. Reply HELP for help and STOP to cancel.*"

Step 2: Initial text message to confirm consent and to ensure that the user sent the correct number - a number that belongs to them.

This is the two text message that will be sent to confirm consent:
- "[Name], you indicated interest in receiving SMS messages from [campaign] powered by HITMKR.com. To confirm, reply YES. Msg frequency varies. Msg & data rates may apply. Text STOP to cancel or HELP for help."
- "Thanks for confirming!" Msg frequency varies. Message and data rates may apply. Read full terms here [https://www.hitmkr.com/fans/terms] and privacy policy here [https://www.hitmkr.com/fans/privacy]. Text STOP to cancel. HELP for help."


3. Opting Out

You can opt-out of receiving SMS messages at any time:

If you opt-out and wish to rejoin, text START to [+14255550889] to resume receiving messages.


Opt Out Confirmation Message

You are unsubscribed from [campaign] messages powered by HITMKR.com. No more messsages will be sent. Reply HELP for help or START to re-subscribe.


4. Help and Customer Care

5. Privacy

Your privacy is important to us. By opting into our SMS service, you acknowledge and agree to our Privacy Policy. We do not sell or share your information with third parties except as necessary to deliver this service.


6. Carriers

Participating carriers include, but are not limited to, Verizon, AT&T, T-Mobile, Sprint, and other major U.S. carriers. While we strive for seamless message delivery, carriers are not liable for delayed or undelivered messages.


7. Your Responsibilities

- You confirm that you are the owner or authorized user of the mobile phone number you provided.
- You must notify us if your mobile number changes to prevent receiving messages intended for someone else.


8. Modifications to Terms

We reserve the right to modify these terms and conditions at any time. Any changes will be communicated to you via SMS or other appropriate methods. Continued participation in the SMS program constitutes acceptance of the modified terms.


9. Governing Law

These terms and conditions are governed by the laws of the state of Delaware.
